These Terms of Service ("Terms") govern access to and use of FleetHelm (the "Service"), a fleet and rental management application provided to businesses ("Customer", "you") and their authorized users. By creating an account, subscribing, or otherwise using the Service, you agree to these Terms on behalf of yourself and the company you represent.
1. Acceptance of terms
You must be at least 18 years old and have authority to bind your company to use the Service. If you do not agree to these Terms, do not use the Service.
2. Accounts & companies
- One company workspace is created per business. The person who creates it is the initial owner/admin and can invite employees.
- You are responsible for the accuracy of information you provide and for maintaining the confidentiality of login credentials.
- You are responsible for actions taken by users you invite into your company workspace.
3. Subscriptions & billing
- Paid plans are billed on a recurring basis (e.g. monthly) via our payment processor (Stripe). A free trial period may be offered; if you do not cancel before it ends, billing begins automatically.
- You can view, update, or cancel your subscription at any time from Settings → Billing, which opens the payment processor's customer portal.
- Except where required by law, fees already charged are non-refundable. If you cancel, you keep access until the end of the current billing period.
- We may change pricing with reasonable advance notice; continued use after a price change takes effect constitutes acceptance.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulation.
- Attempt to gain unauthorized access to other companies' data or to the Service's infrastructure.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to store or process data you do not have the right to collect (e.g. customer or driver data collected without a lawful basis).
- Reverse engineer, resell, or white-label the Service without written permission.
5. Your data & content
- You own the data you enter into FleetHelm (fleet, customer, rental, contract, and invoice records — "Customer Data"). We do not claim ownership over it.
- You grant us a limited license to process Customer Data solely to provide, secure, and support the Service.
- You are responsible for having a lawful basis to collect and store personal data (customers, drivers, employees) that you input into the Service, and for honoring data subject requests you receive.
- You can export or request deletion of your company's data by contacting support; see our Privacy Policy for details on how data is handled.
6. Third-party services
The Service relies on third-party providers to operate, including Supabase (database, authentication, storage), Stripe (subscription billing and, if you enable it, rental/deposit payments), Mailgun (transactional email), and Sentry (error monitoring). If you connect your own third-party accounts (e.g. your own Stripe account, Google or Microsoft calendar), your use of those services is also governed by their respective terms.
7. Availability & support
We aim to keep the Service available and reliable but do not guarantee uninterrupted access. Planned maintenance or third-party outages may cause temporary downtime. Support is available via the in-app Support page or by emailing support@getfleethelm.com.
8. Termination
- You may cancel your subscription and stop using the Service at any time.
- We may suspend or terminate access if these Terms are violated, if fees are unpaid after notice, or if required by law.
- Upon termination, we may retain Customer Data for a limited period to allow export or as required for legal/accounting purposes, after which it may be deleted.
9. Disclaimers & limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose.
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for lost profits or data arising from use of the Service, and our total liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.
10. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated by email or an in-app notice. Continued use of the Service after an update takes effect constitutes acceptance of the revised Terms.
